Nigeria Introduces New Crypto Tax Rules for Exchanges and P2P Platforms

Nigeria has officially begun enforcing a comprehensive cryptocurrency tax framework, placing crypto exchanges and peer-to-peer (P2P) trading platforms at the center of tax collection and reporting.

The rules form part of the Nigeria Tax Act 2025, which became fully effective in January 2026, and are designed to improve transparency while increasing government revenue from the country's rapidly growing digital asset sector.

Under the new regulations, licensed Virtual Asset Service Providers (VASPs) must collect certain taxes directly when crypto transactions occur, bringing Nigeria's regulatory approach closer to international standards for digital asset taxation.

Exchanges Now Collect Taxes at the Source

The new framework requires crypto platforms to withhold taxes automatically for several types of transactions.

According to the guidelines:

  • A 1% withholding tax applies to taxable transactions involving cryptocurrencies, tokenized securities, and certain NFTs.
  • A 10% withholding tax applies to income earned through staking, mining, airdrops, and DeFi activities.
  • A 1.5% fee is charged on transactions converting cryptocurrency into fiat currency.

Regulators also clarified that withholding tax and stamp duty may be remitted using the cryptocurrency involved in the transaction, while Value Added Tax (VAT) must be paid in the same currency used for the underlying payment.

The new rules make exchanges and trading platforms responsible for collecting and forwarding taxes directly to the authorities.

New Reporting and Identification Requirements

The regulations significantly expand compliance obligations for cryptocurrency service providers.

Licensed platforms must now collect and retain customer information, including national tax identification numbers, while complying with Know Your Customer (KYC) and Anti-Money Laundering (AML) requirements.

Operators are also required to submit regular reports containing information such as:

  • Customer names and addresses
  • Types of digital assets held
  • Transaction dates
  • Trading volumes

In addition, transaction records must be retained for at least seven years, allowing authorities to audit historical crypto activity when necessary.

Officials believe the expanded reporting framework will improve transparency and reduce tax evasion within Nigeria's digital asset market.

Capital Gains Rules Remain in Place

The introduction of withholding taxes does not replace Nigeria's existing capital gains tax regime.

Profits generated from:

  • Selling cryptocurrencies
  • Swapping one digital asset for another
  • Using crypto to purchase goods or services

will continue to be subject to a 10% capital gains tax.

Meanwhile, income generated through mining, staking, liquidity provision, and other active crypto activities will continue to be treated as ordinary taxable income, with applicable rates depending on whether the taxpayer is an individual or a business.

Nigeria Aligns With Global Crypto Standards

The new tax regime forms part of Nigeria's broader strategy to integrate digital assets into its national financial and tax systems.

The framework aligns with the Organization for Economic Co-operation and Development's (OECD) Crypto-Asset Reporting Framework (CARF), which is intended to facilitate international tax information sharing between participating jurisdictions.

By adopting CARF-aligned reporting standards, Nigeria joins a growing list of countries implementing detailed cryptocurrency taxation rules that emphasize transparency, cross-border cooperation, and regulatory oversight.

For crypto exchanges, the new regulations introduce significantly greater compliance responsibilities, while investors benefit from clearer guidance on how cryptocurrency income and capital gains will be taxed under Nigerian law.
